Terms of Service

These terms are provided as general information and are not legal advice. Get your own advice before relying on them.

1. Who these terms are between

These terms form an agreement between MyBookingApp and the business that creates an account (“you”). By creating an account or using the platform you accept them.

If you are accepting on behalf of a business, you confirm you are authorised to bind that business.

2. Your account

You are responsible for keeping your login credentials secure and for the actions taken by users you invite to your workspace.

You must provide accurate business details, including your ABN where you are registered for GST, and keep them current.

3. Acceptable use

Do not use the platform to break the law, infringe someone else's rights, send unsolicited marketing without consent, or attempt to access another business's data.

We may suspend an account that puts the platform, other merchants or consumers at risk, and will tell you why where we lawfully can.

4. Fees and payment

Subscription fees are billed monthly in advance in Australian dollars and are exclusive of GST unless stated otherwise.

Card processing costs are set by your payment provider and are separate from your subscription. Where you choose to surcharge, you are responsible for keeping the surcharge within your genuine cost of acceptance.

Plans are month to month. You can cancel at any time, effective at the end of the current billing period. We do not refund part-months.

5. Your data

Your business data remains yours. We process it to provide the service, and you can export it at any time.

You are responsible for having a lawful basis to collect and store your customers' personal information, and for obtaining marketing consent before sending campaigns.

6. Availability and support

We aim for high availability but do not promise uninterrupted service. Planned maintenance is scheduled outside peak Australian trading hours wherever practical.

Support is provided during Australian business hours through the channels listed on our contact page.

7. Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law.

To the extent permitted by law, our liability for any claim connected with the service is limited to the subscription fees you paid in the twelve months before the claim arose.

We are not liable for indirect or consequential loss, including lost profits or lost data where you have not maintained your own exports.

8. Termination

You may close your account at any time. We may terminate for material breach, unlawful use, or non-payment after notice.

After termination we retain records for the period required by law, then delete them.

9. Changes

We may update these terms. Material changes will be notified in the app or by email at least 30 days before they take effect.

10. Governing law

These terms are governed by the laws of Australia, and the courts of Australia have jurisdiction over any dispute.
